Stonington — First Selectman Rob Simmons said Tuesday that the town will not be disciplining highway department employee Daniel Oliverio for allegedly using his cellphone while driving a town truck and when not on a paid break.

Simmons said Public Works Director Barbara McKrell had filed a complaint about Oliverio but the town’s investigation found the incident did not warrant disciplinary action. Simmons said Oliverio has been notified of the decision.

Meanwhile, Simmons said town Labor Attorney Meredith Diette continues to investigate a litany of complaints that Oliverio has made against McKrell, his boss.

So far, Simmons said Diette has interviewed all 18 highway department employees as well as McKrell, Oliverio and Highway Supervisor Tom Curioso twice each. He said he expects Diette’s final report next week.

During each of the past two Board of Selectmen meetings, a large group of residents have spoken in support of Oliverio, who alleges he is being targeted by McKrell. His supporters are once again expected to address the Board of Selectmen when it meets at 7 p.m. Wednesday at the police station.

At the meeting, selectmen also are expected to consider a letter from Oliverio in which he resigns as tree warden.

Oliverio made numerous charges against McKrell in an April 10 email he sent to Simmons and alleges she has unfairly targeted him for discipline. He sent the email hours after he said she had a supervisor question him over a townwide radio system about his stopping for a cup of coffee.
