Editorial: Let's keep Iowa's court system fair, effective
A bill being proposed in the Iowa Legislature this year is, in our opinion, an awful idea.
The bill, as it's being debated, would require the Iowa Supreme Court to vote 5-2 to declare a law unconstitutional. Right now, justices only need a 4-3 vote.
It's hard not to view this with jaded skepticism. After all, the only two groups supporting this change are the Family Leader and the Iowa Faith and Freedom Coalition -- the same folks who worked to convince Iowans to vote out three Supreme Court justices in 2010 following the ruling in support of same-sex marriage in Iowa.
The other four justices in that unanimous ruling remain on the court.
The bill's sponsor said he's not targeting the current court; he just thinks there is too much power in the hands of four justices.
Whether true or not, our opposition is based on a good-government argument. A simple majority is good enough for the U.S. Supreme Court and 48 state Supreme Courts. It works. It's fair.
There's also a separation of power argument. The Legislature shouldn't tell the Supreme Court how to operate any more than the Supreme Court should require the Legislature to pass bills with a supermajority.
Iowans enjoy a court system that's fair, effective and as nonpartisan as any human endeavor can be. Let's keep it that way.
